Terms and Conditions of the Cardiac Research and Education GmbH

Subject of the Contract and Application

Cardiac Research and Education GmbH offers stored videos and video streaming- products. These offers are solely meant to be used by medical specialists. The products only show information and experiences of medical doctors for medical doctors. They don’t intend to be instructions or recommendation. It is not allowed to reproduce, transfer or imitate the presented methods.  

Conclusion of the contract

The customer can buy a product by placing it into the shopping cart and filling up his personal data. He may by then change his data and the chosen product at any time. By clicking the button “zahlungspflichtig bestellen” the customer is submitting a legally binding offer of purchase. Upon receipt the Cardiac Research and Education GmbH will confirm the receipt by email. This confirmation is not the acceptance of the offer of the customer but only the information that the purchase order has been transferred. The contract is only concluded when the Cardiac Research and Education GmbH confirms the acceptance of the order via email or by sending the product. The Cardiac Research and Education GmbH is entitled to refuse the acceptance of the offer.

Scope of supply

Subject and scope of supply are defined in the description of the product, the order form and these terms and conditions. Changing and modification of the product and its content by the customer or third partieds are not allowed. Streaming means: delivery and usage of content without generating a lasting copy on the customer’s device. Streaming products are available for 30 days from the first activation on. Data storage means: delivery of a video for long lasting use on the customer’s device. With conclusion of the contract the customer acquires the non-exclusive right to use the product for an unlimited period of time. He shall not in whole or in part reproduce, sell, resell or license the product. Presentations are only allowed in a private environment and for non-commercial use only.

Prices, costs for shipping and packing

The prices displayed include VAT but exclude delivery costs such as shipping, packing and custom charges. These are indicated on an extra site and will be added
automatically to the total amount during the checkout process. All prices shown on this site are in EURO.

Customer’s obligations

The customer has to provide a powerful internet connection and a performing terminal with an efficient system. He is not allowed to reproduce, modify or work on the content of the product. He may not distribute, publicize, demonstrate in public, resale and advertise the content of the products or support such uses. He may not change or remove copyright indicators.  If the customer intentionally infringes his obligations under the contract with Cardiac Research and Education GmbH he will be responsible for any loss, expenses, charges and third party claims. In case of breach of duty the customer can be excluded from the services.

Right of withdrawal

A customer who is consumer may benefit of a right of withdrawal. He has no right of withdrawal when the customer removes the sealing from a delivered medium.

You have the right to withdraw from this contract within 14 days without stating any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract in case of streaming products or from the day on which you received the goods in case of data stored products.

In order to exercise the right of withdrawal, you must inform us (Cardiac Research and Education GmbH, Unterer Brunnenweg 10, D-66424 Homburg, Fax +49-6841-120984, Email aortic@care-saar.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send of the notification of exercising the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

When you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive delivery method we offer), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. In case of delivery on data stores: We may withhold reimbursement until we have received the goods back or until you have supplied
evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Premature expiration of the right of withdrawal

In case of a streaming product your right to withdraw expires when you explicitly agreed that we begin to fulfill the contract before the withdrawal period has expired and you confirmed your knowledge that if you agree with the early beginning to fulfill the contract you will lose your right to withdraw.

Title retention

The data stored products will stay in Cardiac Research and Education GmbH’s property until the complete payment. 

Warranty for defects

The legal warranty applies.

In case of any controversy or dispute the customer may contact the European platform for online dispute resolution for consumer matters at: http://ec.europa.eu/consumers/odr/ 

General

To all legal relations between the Cardiac Research and Education GmbH and the customer the law of the Federal Republic of Germany shall apply. The United
Nations Convention on the International Sales of Goods will not apply to these Terms or any Contract. Contract language is German.
